是指公安、司法机关及其它行政执法机关对于报案、控告、举报、自首以及自诉人起诉等材料，按照各自的管辖范围进行审查后，认为有犯罪事实发生并需要追究刑事责任时，决定将其作为刑事案件进行侦查或者审判的一种诉讼活动。
